Blaine McSwain, originally from the Panhandle of Texas, joined the firm in 2023. Blaine has experience representing various clients, primarily in litigation matters, including real estate agents and their brokers, physicians, construction companies, and individuals. Blaine has successfully represented tenants and landlords in eviction proceedings, defended professionals in administrative proceedings, defended general and subcontractors in construction/defect disputes, defended individuals in consumer protection litigation, and represented various companies and individuals in breach of contract disputes.
Blaine has successfully obtained temporary restraining orders for clients, defended and won various summary judgment motions, and successfully tried a jury trial to a defense verdict in McLennan County. She has experience working on litigation matters from day one until resolution – either through settlement or judgment.
Blaine has also worked on various appellate matters, including successfully defending a motion for summary judgment in the court of appeals, successfully defending the granting of judgment on the pleadings in the Fifth Circuit, drafting various responses to mandamus petitions, and drafting various other appellate documents and motions.
Prior to joining the firm, Blaine worked for three years in Houston at a boutique insurance defense firm. While there, she primarily worked in construction, professional liability, and personal injury litigation. In Houston, she gained valuable litigation experience working on multi-party construction litigation cases, catastrophic personal injury cases, and defending real estate agents and their brokers by taking and defending countless depositions, arguing various hearings, preparing multiple cases for trial, and successfully resolving cases through settlement.
Blaine graduated Cum Laude from Texas Tech University with a Bachelor of Arts in Journalism before attending law school at Baylor Law, where she graduated Cum Laude. While in law school, Blaine participated in various moot court competitions, including winning the E. Earle Zehmer Nation Moot Court Competition and being a finalist in the Texas Young Lawyers Association State Moot Court competition, where she argued to the sitting Texas Supreme Court.
