Stewart McSwain, a Waco Local, joined Beard, Kultgen, Brophy, Bostwick and Dickson PLLC in August of 2023. Stewart has experience representing various clients, primarily in litigation matters, including truckers and trucking companies, construction companies— both general contractors and subcontractors, and individuals. Stewart has successfully represented landlords in eviction proceedings, represented a Major University in an internal administrative proceeding, represented the proponent of a will in a bench trial, and represented various companies and individuals in breach of contract disputes.
Stewart has successfully drafted and argued substantive and dispositive motions, drafted an appellate brief defending a granted motion for summary judgment in the court of appeals, successfully argued a bench trial in McLennan County Court at Law, and successfully fully argued a jury trial to a total defense verdict in McLennan County District Court.
Prior to joining Beard, Kultgen, Stewart worked for a year and a half in Houston at a boutique insurance defense firm. While there, he primarily worked in construction defect and personal injury litigation, focusing primarily on catastrophic 18-wheeler accidents and multi-family residential construction defect litigation. In Houston, he gained valuable litigation experience working on multi-party construction litigation cases, catastrophic personal injury cases, arguing various hearings, preparing multiple cases for trial, and successfully resolving cases through settlement.
Stewart graduated from Baylor University with a Bachelor of Science in Chemistry before attending Baylor Law School.
